Abstract

The Framework Law on noise pollution (LQ 447/1995) requires the autonomous regions/provinces to issue their own legislation which defines a series of criteria, methods and procedures necessary for the complete implementation of the national law. Since the enactment of LQ 447/95, the regional legislative framework is not yet complete: there are still 5 regions that have not adopted a regional law on noise pollution; some regions, in the absence of a regional law on noise, have approved specific acts.

Description

The indicator reports the list of regulatory acts issued by each Region/Autonomous Province pursuant to LQ 447/95; for completeness of treatment, the regulations issued for the purposes of the obligations set out in Legislative Decree 194/2005 regarding the determination and management of environmental noise, transposition of Directive 2002/49/EC, have also been included among the regional regulatory acts. The indicator provides an overview of the regional legislation on noise pollution, based on the information provided by ARPA/APPA and collected by ISPRA.

Purpose

Evaluate the response of the Regions/Autonomous Provinces in relation to the regional competence obligations envisaged by LQ 447/95 and the obligations envisaged by Legislative Decree 194/2005.

LQ 447/95 provides, in art. 4 paragraph 1, that, within one year of its entry into force, the autonomous regions/provinces are to issue their own legislation which defines the criteria for the municipal acoustic classification, the methods for issuing municipal authorizations for carrying out temporary noisy activities and the criteria for drawing up the acoustic impact documentation and the acoustic climate assessment, as well as a series of other criteria and methods of application of the rule itself.

The indicator is extremely relevant in describing the response of the autonomous regions/provinces regarding the implementation of the legislation on noise pollution and presents reliability and reliability of the measurement and data collection methods. The indicator has spatial coverage at a national level, as the current regulatory requirements regarding noise pollution issued by the autonomous regions/provinces are reported.

Since the issuance of the LQ, the regional legislative framework is not yet complete: 5 regions have not adopted a law on noise pollution; of these, 3 regions have however approved specific acts.

Comments

Table 1 shows the list of regional laws/resolutions issued in reference to article 4 of LQ 447/95 and all regional regulatory acts regarding noise pollution. There are still 5 regions that do not have a regional law on noise pollution: Molise, Campania, Basilicata, Sicily and Sardinia (Figure 1). In the absence of a regional law, guidelines for municipal noise classification were issued in Campania and Sicily, while in Sardinia a resolution was issued that defined regional directives on noise pollution. In Molise and Basilicata no regulation governing the matter has yet been issued.
